eSight Home Experience Terms
Please read these terms and conditions (the “HomeEx Terms”) that are applicable to the Home Experience program that is offered by Gentex Corporation and its affiliates (“we,” “us,” “our,” and “Gentex”) for the fifth generation eSight Go product (“eSight Go”). These HomeEx Terms incorporate by reference the Terms of Service (except for Section 7 (Warranty) of the Terms of Service). All capitalized terms not otherwise defined in these HomeEx Terms will have the meaning set forth in the Terms of Service. If there is a conflict between these HomeEx Terms and the Terms of Service, these HomeEx Terms will control.
Gentex offers a Home Experience Trial (as defined below) for customers who are purchasing eSight Go for the first time. By electing to participate in the Home Experience Trial, you agree to abide by the HomeEx Terms, Terms of Service, and any other terms and conditions incorporated herein by reference.
1. Home Experience Trial and Eligibility. Gentex offers a trial period for customers who purchase eligible eSight Go and related Services directly from Gentex (the “Home Experience Trial”). Only new customers of eSight Go, purchased directly from Gentex, are eligible to participate in the Home Experience Trial program. For clarity, even if a customer has purchased eSight 4 or older eSight products (i.e., a product other than eSight Go), as long as the customer has not purchased eSight Go, the customer is eligible to participate in the Home Experience Trial. In addition, these HomeEx Terms will NOT apply if you purchase eSight Go through any of our authorized distributors. Eligible products and services for the Home Experience Trial will be determined by Gentex and may be updated from time to time by Gentex in its sole discretion, with or without notice to you.
2. Home Experience Trial Period. For the Home Experience Trial, you will be permitted to access and use an eligible eSight Go and related Service for twenty-one (21) calendar days (the “Home Experience Trial Period”) beginning on the date that eSight Go departs from our facilities (the “Commencement Date”). If the eSight Go does not reach you within seven (7) calendar days of the Commencement Date and you notify us of this fact, then we will investigate the reason for any delay and, in our sole discretion, either extend the Home Experience Trial Period for a defined period or provide you with another eSight Go and offer you an additional Home Experience Trial Period beginning on the Commencement Date of the additional product unity under the above conditions.
3. Payment. If you wish to participate in a Home Experience Trial, you may be asked to supply certain relevant information, such as your payment card number and its expiration date, your billing address, and your shipping information, to us or our payment processors.
4. Returned Items. At the end of the Home Experience Trial Period, you shall either (i) purchase the eSight Go and all applicable accessories (in accordance with the Terms of Service) or (ii) return the eSight Go and all applicable accessories to Gentex in accordance with the Return Policy. Notwithstanding the requirements set forth in the Return Policy, the following requirements specifically govern returns at the end of a Home Experience Trial:
a. At the end of the Home Experience Trial Period, if you do not purchase eSight Go and all applicable accessories, your right to access and use an eligible eSight Go, the applicable accessories and applicable Services are terminated and you must return the eSight Go and all applicable accessories (the “Returned Items”) to Gentex within seven (7) calendar days after your Home Experience Trial Period ends.
b. If we do not receive eSight Go or any applicable accessory after seven (7) calendar days from the end of your Home Experience Trial Period, you may be charged a late fee. After a set number of days, which will be determined at Gentex’s sole discretion, the eSight Go and any applicable accessory will be considered to be lost and you will be responsible for the full replacement cost of eSight Go and all applicable accessories.
c. If Gentex decides, at its sole discretion, that eSight Go or any of the accessories are damaged or not in working order upon return, Gentex may charge you additional fees up to the full amount of replacing (i) eSight Go (which shall be the then-current cost of eSight Go posted on the Site) and (ii) each applicable accessory (which shall be up to be one hundred and fifty-three dollars ($153)).
d. By providing a credit card or other payment method accepted by Gentex when you make a transaction to participate in a Home Experience Trial, you further authorize us to process any refund, returned payments, or impose charges incurred by you under these HomeEx Terms via the same payment method (debit card, credit card, ACH) you provided at the time of checkout or payment to us for the purchase of eSight Go. In the event legal action is necessary to collect on balances due, you will reimburse us and our vendors or agents for all expenses incurred to recover sums due, including attorneys’ fees and other legal expenses.
5. Responsibility. You assume full responsibility for eSight Go in your possession during the Home Experience Trial Period (including loss, theft, damage, ordinary wear and tear, or any other liability).
