eSight Consumer Health Data Privacy Policy

This Consumer Health Data Privacy Policy supplements the eSight Privacy Policy and provides additional information about how Gentex Corporation (“Gentex”) collects, uses, and discloses consumer health data as required by laws like Washington’s My Health My Data Act and Nevada’s Consumer Health Data Privacy Law. This Privacy Policy applies to the eSight services that process consumer health data, including when you download, access or otherwise use the website located at https://www.esighteyewear.com (or any successor links) and all associated web pages, web apps, (the “Site”), and services accessible through the Site (collectively “Services”).

Collection of Consumer Health Data

We collect consumer health data that you provide through the Services, whether directly or indirectly, with your consent or at your direction, as well as where necessary to provide you with a service you have requested. The consumer health data we collect includes:

  • Medical records or other information about your health including medical conditions, prescriptions for glasses and/or contact lenses you may be using, or medical diagnoses;
  • Medical or health information you may submit through a consultation form for eSight or as relevant to your use of eSight; and
  • Information regarding your medical provider and/or clinic.

Sources of Consumer Health Data

We collect consumer health data directly from you, including if you choose to provide it to one of our eSight coaches, as well as from your interactions with the Services, and from your medical provider at your direction.

Use of Consumer Health Data

We collect and use consumer health data for the following purposes:

  • Assess your candidacy for the eSight products and Services;
  • Contact you regarding a consultation regarding your candidacy for an eSight device;
  • Respond to medical information queries and quality complaints regarding an eSight device;
  • Provide you with the eSight Services as necessary, which may include eSight coaching sessions tailored to your condition; and
  • With your consent as required by law.

Disclosure of Consumer Health Data

We may share each of the categories of consumer health data described above with the following categories of third parties:

  • Vendors, consultants, and other service providers may access consumer health data to carry out work on our behalf; and
  • With your consent or at your direction.

Your Privacy Rights

You can access or delete your consumer health data or withdraw consent to our processing of your consumer health data, subject to certain exceptions. You can request to exercise these rights by emailing [email protected].
