This Privacy Policy applies to the eSight product and services, and explains how Gentex Corporation and its affiliates (“Gentex”) collect, use, and disclose information when you download, access or otherwise use the website located at https://www.esighteyewear.com (or any successor links) and all associated web pages, websites, and social media pages (the “Site”), eSight hardware products (“eSight”), the eSight applications (the “App” or “Application”), and the services accessible through the Site and/or the App, (collectively “Services”). Information You Provide to Us
We collect information you provide directly to us. For example, we collect information when you participate in any interactive features of the Site or App, create an eSight account, disclose medical records or other information about your health to us to determine whether you are eligible for or to help you get set up and use eSight or when you participate in any product study or testing, complete a consultation, fill out a survey or webform, make a referral, request information about our products, sign up for email updates about our products, communicate with us via third party social media sites, request customer support, report adverse events regarding your use of eSight, provide safety information concerning our products, submit product quality complaints, submit a warranty request, participate in a recall, or otherwise communicate with us. The types of information we may collect include your name, email address, postal address, telephone number, your medical provider’s name, information about your health relevant to your use of eSight, and any other information you choose to provide. If you are a healthcare provider, we also collect information when you make a referral, including your name and contact information and the referred patient’s name and contact information.
Automatically Collected Information
When you access or use our Site or App, we automatically collect information about you (or your device), including:
- Device and Log Information: We collect information about your use of our Services. This includes usage information about our eSight devices (including how you interact with the eSight device and the features you use – e.g., the brightness or zoom levels), the type of browser you use to visit our Site, access times, pages viewed, your IP address, the page you visited before navigating to our Site. We collect information about the computer or mobile device you use to access our Site or App, including the hardware model, operating system and version.
- Information Collected by Cookies and Other Tracking Technologies: We use different technologies to collect information about your interactions with our Site or App, including cookies, web beacons, and SDKs. Cookies are small data files stored on your hard drive or in device memory that help us improve our Site or App and your experience, see which areas and features of our Site or App are popular, and count website visits. Web beacons are electronic images that may be used in our Site or App or emails and help deliver cookies, count visits, and understand usage. SDKs are software development kits or tools that we use in our mobile applications, some of which allow us to see which features of our Site or App are popular. Information We Collect from Other Sources
We may obtain information from other sources and combine that with information we collect through our Services. For example, we may receive contact information about you if you direct your healthcare provider to share it with us to help get you set up with the eSight device or if your healthcare provider shares your contact information with us as a part of a referral. We may also receive information about you from publicly available sources, such as if you interact with us on social media.
Use of Information
We primarily use the information we collect to provide, maintain, and improve our Services. We may also use the information we collect to:
- Send you technical notices, updates, security alerts, and support and administrative messages;
- Respond to your comments, questions, and customer service requests;
- Respond to medical information queries and quality complaints regarding eSight;
- Communicate with you about products, services, offers, and events offered by Gentex and others, and provide news and information we think will be of interest to you;
- Monitor and analyze trends, usage, and activities in connection with our Site or App;
- Monitor and maintain the safety of eSight, including detecting, assessing, preventing adverse events, reporting adverse events to health authorities, and processing recalls;
- Detect, investigate and prevent fraudulent transactions and other illegal activities and protect the rights and property of Gentex and others;
- Personalize and improve the Services;
- Comply with our legal and financial obligations; and
- Carry out any other purpose described to you at the time the information was collected.
Disclosure of Information
In certain circumstances, we disclose information about you. We disclose personal information as described in this Privacy Policy and in the following circumstances:
- With vendors, consultants, and other service providers who need access to such information to carry out work on our behalf;
- With eSight specialists or coaches, who are Gentex employees, and who may help you use our Services, including as a part of eSight coaching offerings;
- In response to a request for information if we believe disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet regulatory or law enforcement requirements;
- Target advertisements to you on third-party platforms and websites (for more information and to opt out, see the Targeted Advertising and Analytics section below);
- If we believe your actions are inconsistent with our user agreements or policies, or to protect the rights, property, and safety of Gentex or others;
- In connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of our business by another company;
- Between and among Gentex and our current and future parents, affiliates, subsidiaries, and other companies under common control and ownership; and
- With your consent or at your direction.
We may also disclose aggregated or de-identified information, which cannot reasonably be used to identify you. We will not attempt to re-identify such information, except as permitted by law.
Targeted Advertising and Analytics Services Provided by Others
Although we engage in certain advertising and marketing activities, please note that we do not use personal information collected from the eSight device or App to advertise to you and we do not sell information from the eSight device or App with third parties. We may allow others to provide analytics services, serve advertisements, and perform related services for us across the web, including by showing ads to you about our Services on third-party websites and in third-party mobile apps. These entities may use cookies, web beacons, SDKs, device identifiers, and other technologies to collect information about your use of the Site and other websites, including your IP address, web browser, mobile network information, pages viewed, time spent on pages, and links clicked. This information may be used by Gentex and others to, among other things, deliver advertisements targeted to your interests on other companies’ sites or mobile apps, analyze and track data, determine the popularity of certain content, and better understand your online activity. You can also learn more about interest-based ads or opt out of having your web browsing information used for behavioral advertising purposes by companies that participate in the Digital Advertising Alliance by visiting www.aboutads.info/choices if you reside in the United States.
In addition to cookie-based ad targeting, we may disclose identifiers, like email addresses, to some of our advertising providers. These advertising providers translate that information into a unique identifier that can then be used to show ads that are more relevant to you across the web and in mobile apps.
Depending on where you reside, you may have additional choices available to you with respect to practices described in this section, which are set out below in the Opting Out of Targeted Advertising, Sharing, and Sales section below.
Data Retention
We store the information we collect on you for as long as is necessary for the purpose(s) for which we originally collected it, or for other legitimate business purposes, including to meet our legal, regulatory, or other compliance obligations.
Transfer of Information to the U.S. and Other Countries
Gentex is based in the United States and we process and store information in the U.S. and other countries. Therefore, we and our service providers may transfer your information to, or store or access it in, jurisdictions that may not provide equivalent levels of data protection as your home jurisdiction. We will take steps to ensure that your personal information receives an adequate level of protection in the jurisdictions in which we process it.

Cookies and Similar Tracking Technologies
Gentex uses cookies and similar tracking technologies to analyze visits to and use of our Site and App and how consumers are interacting with our marketing communications, including Google Analytics cookies. You can usually choose to set your browser to remove or reject browser cookies. Specifically for Google Analytics cookies, you can use the Google Analytics Opt-out Browser Add-on https://tools.google.com/dlpage/gaoptout. Please note that this option is not available for every Internet browser. Promotional Communications
You may opt out of receiving promotional emails that you request from Gentex by following the instructions in those emails or by emailing us at [email protected]. If you opt out, we may still send you non-promotional emails, such as those about your account or our ongoing business relations.
Mobile Push Notifications
With your permission, we may send push notifications to your mobile device if you use our App. You can deactivate these messages at any time by changing the notification settings on your mobile device.
MINORS
You must be at least 18 years of age to purchase eSight and to otherwise use our Site or App. If you are a parent or legal guardian, you will have the option to purchase eSight for your child. If you believe that your child provided their personal information to us, please contact us at [email protected]. If you are under 18 years of age, you can use eSight purchased by your parent or legal guardian and use our Site and App with parental supervision.

- We may collect personal information about consumers under the age of 16 if such personal information is provided by their parent or guardian. We do not otherwise knowingly sell, or share personal information about consumers under the age of 16.

Your Privacy Rights
Opting Out of Targeted Advertising, Sharing, and Sales
Some of the activities described in the Targeted Advertising and Analytics section above may be considered “sales” or “sharing” of your personal information or use of your information for “targeted advertising” under the law that applies to you.
Depending upon where you reside, you can opt out of cookie-based ad targeting by emailing us at [email protected]. You may need to renew your opt-out choice if you visit our website from a new device or browser or if you clear your cookies because your opt-out choice will be linked to your browser only.
If you reside in a location, such as in California or other regions that have laws governing Global Privacy Control signals, you can also opt out by visiting our Services with a legally recognized universal choice signal enabled (such as the Global Privacy Control). Our processing of the signal will be limited to cookie-based sales, sharing, and targeted advertising for the specific browser or device that you are using.
Access, Deletion, and Correction
Depending upon where you reside, you may have the right to (1) request to know more about and access your personal information, including in a portable format, (2) request deletion of your personal information, and (3) request correction of inaccurate personal information. We may verify your request by asking you to provide information related to your recent interactions with us, such as providing information about last product bought and date of such purchase.
Authorized Agents
Depending on which state you are a resident of, state law may allow you to designate an authorized agent to submit a privacy rights request on your behalf. We may ask authorized agents to submit proof of their authority to make the request, such as a valid power of attorney or proof that they have signed permission from the individual who is the subject of the request. In some cases, we may contact the individual who is the subject of the request to verify his or her own identity or confirm the authorized agent has permission to submit the request. Appeals
If we deny your request, you may appeal our decision by contacting us at [email protected]. If you have concerns about the results of an appeal, you may contact the attorney general in the state where you reside.
Nondiscrimination
We will not discriminate against you for exercising your privacy rights.
Residents Of Canada
If you are a Canadian resident, this section applies to you.
Consent: By submitting personal information to Gentex, or our service providers and agents, you consent to the collection, use, disclosure, and transfer of your personal information in accordance with this Privacy Policy and as permitted or required by law.
You may withdraw your consent at any time to the collection, use, disclosure, or transfer of your personal information by contacting Gentex as set forth in the Questions or Complaints section below. If you withdraw your consent (or if you decide not to provide certain personal information), you acknowledge that Gentex may not be able to provide you, or continue to provide you, with certain products, services, or information that may be of value to you.
Transfers out of Canada/Quebec: Note that personal information may be stored, accessed, used and otherwise processed inside and outside of Quebec and/or Canada. When personal information is located outside Quebec and/or Canada, it may be subject to laws that have different standards of protection and may allow for foreign law enforcement and governmental access.
Access and Correction: We will take reasonable steps to ensure the personal information we hold is accurate, complete, and up-to-date. Upon your written request, and subject to certain exceptions provided by law, we will inform you of the existence, use, and disclosure of your personal information and give you access to that information. We may charge a minimal fee for providing such access to you. If you believe that the personal information that we hold about you is not accurate or complete, you may write to us at [email protected]. If you are able to establish that the information is not accurate or complete, we will take reasonable steps to delete and/or correct the information so that it is accurate, complete, and up-to-date. In order to facilitate a request to correct or update information, we may ask you to provide additional information to confirm your identity. Any such information will only be used for the purpose of confirming your identity and will not be retained by us.
If you are a resident of Quebec, we will inform you if we exclusively use automated processing to render a decision about you. You also have the right to request information about the personal information used to make that decision, and to request that the information be corrected. Residents of Quebec may also request data in a portable format, subject to certain restrictions and exceptions.
Canada’s Anti Spam Law (“CASL”): Gentex will only send you commercial electronic messages (“CEMs”) where we have your express or implied consent to do so. Your consent to receive CEMs is implied where we have an existing business relationship with you, or you have reached out to us and made an inquiry within a certain time frame. You may unsubscribe from receiving CEMs at any time, by clicking the unsubscribe button on an email. If you opt out, we may still send you non-promotional messages, such as those about your account or our ongoing business relations.
